These Terms of Service ("Terms") govern your use of Levant Health ("Service"), including our website at https://getlevant.com and all related telehealth services. By accessing or using Levant Health, you agree to be bound by these Terms.
If you do not agree to these Terms in their entirety, you are not permitted to use our services. We may modify these Terms at any time by posting updated terms on our website. Your continued use of the Service constitutes acceptance of the updated Terms.
Service Description
Levant Health provides telehealth services connecting patients with licensed healthcare providers for the evaluation and management of weight loss and GLP-1 medications. Our services include:
- • Initial health assessment questionnaire
- • Consultation with licensed healthcare providers
- • Medical evaluation and prescription issuance
- • Compounded medication dispensing and delivery
- • Ongoing clinical support and follow-up care
Levant Health is not a substitute for in-person medical care. We do not provide emergency services. For urgent medical concerns, please seek immediate care at your nearest emergency room or call 911.
Eligibility Requirements
To use Levant Health services, you must meet the following requirements:
Age Requirement
You must be at least 18 years of age. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
Residency Requirement
You must be a resident of the United States. We currently only provide services to US-based patients. You represent that you reside in the United States and comply with all applicable state and federal regulations.
Medical Eligibility
Your healthcare provider will evaluate your medical eligibility during the consultation process. Not all individuals are appropriate candidates for GLP-1 medications. Your provider will determine if treatment is medically appropriate for you based on your health assessment.
Telehealth Consent and Acknowledgments
Informed Consent
You acknowledge that telehealth is different from in-person medical care. By using our services, you consent to receiving medical consultations via telehealth video or phone. You understand the limitations of telehealth diagnosis and treatment.
Risks of Telehealth
You acknowledge and understand the potential risks of telehealth, including: inability to conduct a complete physical examination; potential for miscommunication due to technology limitations; potential loss of privacy depending on your location; and the possibility that telehealth may not be appropriate for complex medical situations.
Technology Requirements
You are responsible for providing adequate technology to participate in telehealth consultations, including a device with video and audio capability and a reliable internet connection. We are not responsible for technology failures or internet connectivity issues on your end.
Privacy During Consultation
You are responsible for ensuring you are in a private location during your consultation. We recommend using a private room or location where others cannot hear or view your consultation.
Subscription & Payment Terms
Monthly Recurring Subscription
Levant Health operates on a monthly subscription model. Once approved for treatment, you will be charged a monthly subscription fee for ongoing access to your healthcare provider, medication, and clinical support. The initial month may include a promotional rate.
Automatic Renewal
Your subscription will automatically renew on a monthly basis unless you cancel. Your payment method will be charged automatically on the monthly renewal date. You are responsible for maintaining accurate payment information.
Cancel Anytime
You may cancel your subscription at any time without penalty. Cancellation can be requested through your account settings or by contacting customer support. Cancellation takes effect at the end of your current billing period.
Billing
You authorize us to charge your payment method for the subscription amount. All charges are in USD. You agree to pay all taxes, fees, and other charges associated with your subscription. We are not responsible for declined transactions or expired payment methods.
Cancellation & Refund Policy
Subscription Cancellation
You may cancel your subscription at any time. Cancellation requests submitted before your renewal date will prevent automatic charging for the next billing period. Cancellation does not entitle you to a refund for services already provided or fees already paid.
Refund Policy
We do not offer refunds for completed consultations or shipped medications. If you believe you have been charged in error, contact us within 30 days of the charge. Refund eligibility is determined on a case-by-case basis.
Medication Returns
Due to safety and regulatory requirements, we cannot accept returns or exchanges of medications. Unused medications should be disposed of according to FDA guidelines or returned to a local pharmacy take-back program.
Important: Compounding Medication Disclaimer
The medications prescribed through Levant Health are compounded formulations and are NOT FDA-approved.
While the active pharmaceutical ingredients in our compounded medications are the same as those found in FDA-approved medications (such as Ozempic®, Wegovy®, Mounjaro®, and Zepbound®), the compounded formulations themselves have not undergone FDA approval. Compounding allows us to provide these medications at more affordable prices.
You acknowledge and accept that:
- • The medications are compounded and not FDA-approved
- • Compounding pharmacies are regulated by state pharmacy boards
- • The efficacy and safety may differ slightly from brand-name medications
- • You assume all risks associated with compounded medication use
- • Your healthcare provider has determined compounded medications are appropriate for you
If you have concerns about compounded medications, discuss them with your healthcare provider or contact us for more information.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Levant Health AND OUR HEALTHCARE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount you paid to Levant Health in the 12 months preceding the claim, or $100, whichever is greater.
Dispute Resolution
Informal Resolution
Before pursuing formal legal action, you agree to first attempt to resolve any dispute informally by contacting us at support@getlevant.com with a detailed description of the dispute.
Binding Arbitration
Any dispute arising from or relating to these Terms or your use of Levant Health shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court. The arbitration shall be conducted on an individual basis, not as a class action.
Exceptions
This arbitration provision does not apply to claims brought before small claims court if you are eligible. Either party may seek injunctive relief in court to prevent infringement of intellectual property rights or breach of confidentiality obligations.
Intellectual Property
All content on Levant Health, including text, graphics, logos, images, and software, is the property of Levant Health or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or transmit any content without our prior written consent.
You retain all rights to any information you provide to Levant Health, including your personal data and health information. However, by providing this information, you grant Levant Health a license to use it for the purposes described in our Privacy Policy.
Privacy
Your use of Levant Health is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal and health information. By using our services, you consent to our Privacy Policy.
Modifications to Terms
We may modify these Terms at any time. Material changes will be posted on our website with notice of the revision date. Your continued use of Levant Health following the posting of changes constitutes your acceptance of the updated Terms. If you do not agree to any changes, your sole remedy is to discontinue use of our services.
Governing Law
These Terms and your use of Levant Health shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the state and federal courts located in Kentucky, and you consent to the jurisdiction and venue of such courts.
